Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TastePapa mobile application and related services (the "Service"), provided by TastePapa ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed and accepted these Terms on your behalf.

2. Account Registration

You may register an account using Apple Sign In, Google Sign In, or email and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate information and to notify us promptly of any unauthorized access.

3. Subscription Services

The Service offers an optional paid subscription, "TastePapa Pro." Subscription pricing, billing period, and any free trial are disclosed in the app prior to purchase. Subscriptions are billed through the Apple App Store or Google Play and renew automatically until canceled. Detailed subscription terms, including auto-renewal, cancellation, and refund information, are set forth in the TastePapa Subscription Terms, which form part of these Terms.

4. AI Features

The Service includes AI-assisted features such as recipe generation, recipe import, recipe translation, and the Ask Papa assistant. AI output is generated automatically and may be inaccurate, incomplete, or unsuitable for your individual needs. You are responsible for reviewing all AI-generated content, including ingredient lists for allergens, before preparation or consumption.

Nutritional information provided by the Service is an estimate for informational purposes only and does not constitute medical, dietary, or professional advice.

5. User Content

You retain ownership of recipes, notes, photos, and other content you submit to the Service ("User Content"). You grant us a limited, non-exclusive, royalty-free license to host, store, process, sync, translate, and display your User Content as necessary to operate the Service for you. We do not use your private User Content to train third-party AI models.

6. Imported Content

When you import a recipe from a third-party source, including websites, Instagram, or TikTok, you represent that you have the right to save the content for personal use. We are not affiliated with third-party platforms and are not responsible for the content imported from them.

7. Acceptable Use

You agree that you will not:

• Reverse engineer, decompile, or extract source code, model weights, or training data from the Service.
• Bypass rate limits, quotas, or paywalls, or interfere with the operation of the Service.
• Submit content that is unlawful, harmful, harassing, or that infringes the rights of others.
• Use the Service to develop a competing product or to train a competing AI model.
• Use automated systems to access or interact with the Service beyond ordinary personal use.

8. Intellectual Property

The Service, including its software, design, branding, and content provided by us, is the property of TastePapa and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

9. Termination

We may suspend or terminate your access to the Service if you violate these Terms or create risk for the Service or other users. You may terminate your account at any time through Settings > Account > Delete account or via the web deletion form.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy of AI-generated content, and uninterrupted availability, to the fullest extent permitted by law.

11. Limitation of Liability

To the fullest extent permitted by law, TastePapa shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our aggregate liability for any claim shall not exceed the greater of (a) the amount you paid for the Service in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars (USD $100).

12. Indemnification

You agree to indemnify and hold harmless TastePapa from any claims, damages, or expenses arising out of your violation of these Terms, your User Content, or your misuse of the Service.

13. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws principles. Disputes shall be resolved in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the app or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
